La Rue explained that a person could be questioned because they are a potential witness to a crime, as part of a fact-finding mission in an investigation, and when they are under arrest and treated as a criminal suspect.

"Most people are unaware of their rights when questioned by police. Specifically, Officers are trained to use certain tactics to get a confession from someone they suspect of wrongdoing," he said.

He elaborated: "While it is critical for those being questioned by law enforcement to determine why the police are talking to them in the first place, it is all too common that we fail to establish the particulars: are they a person of interest in a crime, or are they viewed as a likely witness in a case the police are investigating.”

"If an officer approaches someone in a consensual encounter, that person does not have to talk to the authorities. If they do not want to answer an officer's questions, they should ask the officer if they are free to leave, and walk away, making their intentions not to engage clear."

Many people are unaware they cannot leave during an investigative detention even though they are not under formal arrest. Such detention is usually only for a very limited time while police conduct their investigations. "But they still don't have to answer law enforcement’s questions if they don't want to," said Mr La Rue.

He asserted: "An arrest is different because, at that point, a person has typically been placed in handcuffs and been committed to police custody, and police can search a suspect before taking them to the police station. But as long as that person provides their name and address, they can choose to remain silent and not answer any questions.''

"Anyone being questioned by law enforcement should know that officers use certain tactics to get people to make statements against their own interests. In fact, the law allows police and law enforcement to lie to their suspects and witnesses in their attempt to “investigate” the crime. The best rule is to remain silent until they have a lawyer by their side as that is everyone’s constitutional right, and they should exercise it! To choose not to, is to do so at your peril."
