The Fiduciary Litigation Landscape, State and Federal Law's Impact on Settlement Agreements, and Other Topics To Be Addressed at ALI CLE Progr

CHICAGO - April 26, 2018 - PRLog -- American Law Institute Continuing Legal Education (ALI CLE) has announced that Representing Estate and Trust Beneficiaries and Fiduciaries 2018 will be held on July 19 – 20, 2018, in Chicago. This one-of-a-kind program examines the shifting landscape that representatives of trust and estate beneficiaries and fiduciaries and is updated annually to focus on recent developments in the estate and trust world with a focus on strategy to avoid or prevail controversy.

Representing Estate and Trust Beneficiaries and Fiduciaries will offer attendees perspectives of a broad-based national faculty and insights for representing the colliding interests of lawyers and settlors, beneficiaries and fiduciaries, and among beneficiaries – an often overlooked area in traditional trust and estate programs. Lauren J. Wolven of Levenfeld Pearlstein, LLC of Chicago joins the faculty this year as a Planning Co-Chair, bringing a fresh perspective to the programming. The conference's unique learning culture encourages personal connection while challenging opposing views to yield logic-based resolutions. This year's course will analyze a broad range of topics, including fiduciary litigation (developments and settlement), litigation strategy, drafting techniques, and addresses ethical concerns.

Other topics to be addressed include:

·       Celebrity estates

·       Trustee issues

·       Drafting settlement agreements

·       Non-judicial settlement agreements

·       Trust taxation

"At its core, this program is about probate-related controversy—avoiding it, dealing with it, settling it, or prevailing in it—and has the unique character of filling the space between conventional estate and trust planning and administration programs and litigation programs," said Planning Co-Chair Steve Fast of Day Pitney, West Hartford, Connecticut. "This year's conference analyzes a broad variety of topics, including developments in state and federal law, the fiduciary litigation landscape, business interests in trusts, and virtual and actual settlement agreements. Attendees will also see presentations on areas of interest ranging from trust taxation to 'lessons learned' from recent celebrity estate controversies. Ethical topics including privilege, conflicts, and engagements will be discussed during the program with those in attendance receiving two full hours of CLE credit. As in past years, this course will feature an engaging and entertaining atmosphere."
